Terms of Service

Welcome to Waymark. By accessing or using our platform at waymarkexperiences.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. About Waymark

Waymark is a platform that helps travel content creators ("Creators") convert social media content into bookable travel guides ("Blueprints"). Travelers can discover and book experiences, accommodations, and dining through these Blueprints. Businesses and individuals offering bookable experiences are referred to as "Hosts."

2. Eligibility

You must be at least 18 years old to use Waymark. By creating an account, you represent that all information you provide is accurate and complete.

3. Creator Terms

As a Creator on Waymark:

You may submit YouTube and Instagram links to generate Blueprints from your content
You retain full ownership of your original content. By submitting a link, you grant Waymark a limited license to process and display extracted place information in your Blueprint
You are responsible for ensuring you have the right to submit the content you provide
You earn a 5% commission on bookings made through your Blueprints
Commissions are paid monthly via Stripe, with no minimum payout threshold
Waymark retains 12% of each booking value as a platform fee, charged to the Host
Earnings are confirmed 48 hours after each visit and paid on the 1st of each month

4. Host Terms

As a Host offering bookable experiences on Waymark:

You are responsible for the accuracy of your listing information, including pricing, availability, and experience description
You agree to honor confirmed bookings made through the platform
Waymark charges a 12% commission on each booking completed through the platform
Hosts must be manually approved by Waymark before going live on the platform
Waymark reserves the right to remove listings that do not meet quality standards or generate traveler complaints

5. Traveler Terms

As a traveler booking through Waymark:

Booking confirmations are sent by email and link back to the relevant Blueprint
Cancellation and refund policies are set by individual Hosts and disclosed at the time of booking
Waymark-exclusive pricing and offers are valid only at the time of booking and cannot be retroactively applied

6. Instagram and Third-Party Platform Data

When you connect your Instagram account to Waymark, you authorize us to access caption data from posts you submit, as permitted by the Meta Platform Terms. You may revoke this authorization at any time through your Instagram settings. Waymark's use of data obtained from Instagram is subject to Meta's Platform Terms in addition to these Terms.

7. Prohibited Uses

You may not use Waymark to:

Submit content you do not own or have rights to
Create fraudulent Blueprints with false or misleading information
Attempt to manipulate earnings, bookings, or ratings artificially
Scrape, reverse-engineer, or otherwise interfere with the platform
Violate any applicable laws or third-party platform terms (including Meta's and YouTube's)

8. Intellectual Property

The Waymark platform, branding, and technology are owned by Waymark and protected by applicable intellectual property laws. Creators retain ownership of their original content. Extracted Blueprint data (place names, GPS coordinates, descriptions) is generated by Waymark's AI pipeline and is owned by Waymark, displayed under license to the Creator.

9. Disclaimer of Warranties

Waymark is provided "as is" without warranties of any kind. We do not guarantee that Blueprints will generate a specific level of earnings, that extracted place information will be 100% accurate, or that all bookings will be fulfilled without issue. We are not responsible for the quality of experiences provided by Hosts.

10. Limitation of Liability

To the maximum extent permitted by law, Waymark shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to lost earnings, missed bookings, or inaccurate Blueprint content.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. You may close your account at any time by contacting us. Upon termination, any pending earnings that have been confirmed will be paid out on the next scheduled payout date.

12. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Montreal, Quebec.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of Waymark after changes are posted constitutes acceptance. We will notify you of material changes via email.
